Overview

Fancrick operates a mobile app under its flagship brand, Fancrick, encompassing all text, images, audio, code, and other materials provided by Fancrick (collectively, the “Content”), alongside all features, contests, and services they offer. Fancrick’s online sports gaming platform (“Platform”) allows gamers (“you,” “gamer,” “user,” or “participant”) to leverage their knowledge and analysis of professional sports to predict player performances, milestones, and outcomes, with the potential to win prizes. The Platform currently supports cricket prediction and fantasy cricket games on its mobile apps (“Fancrick App” or “App”) available on Google Play Store, Apple App Store, and through the Fancrick website - Fancrick.com (“Site”). Collectively, the website, mobile apps, and any other features, tools, materials, or services (including co-branded or affiliated services) offered periodically by Fancrick are referred to as the “Service.” The various contests, competitions, and other fantasy games organized on the Fancrick App are referred to as “Contests.”

Please read these Terms of Use (the “Terms” or “Terms of Use”) carefully before using the Service. By accessing or using the Service, or by clicking to accept or agree to these Terms when that option is presented, you accept and agree to these Terms and our additional Rules and Scoring System. You consent to the collection, use, disclosure, and other handling of information as described in our Privacy Policy and agree to any additional terms, rules, and conditions of participation in specific contests issued by Fancrick from time to time. If you do not agree to the Terms, you may not access or use the App/Platform/Site/Content/Services.

Fancrick may issue additional terms, rules, and conditions of participation for particular contests. For example, Fancrick may implement conditions required by the rules and regulations of various states and union territories of India, which may affect your experience or participation in the Service. You agree to comply with these additional rules if you participate in such contests.

Information Collection

To use the services (gaming and rewards) on the app, users must share the following personally identifiable information:

• Name
• Mobile number
• Email address

This information helps verify your identity on the app and maintain and display your gaming and rewards details. Fancrick uses the collected information to facilitate app login, and send you emails and/or SMS messages related to Fancrick activities and offers. You may grant permission for Fancrick to capture and record your device, operating system, network, and location information. You can also opt to share additional information such as gender and date of birth, which can help us send personalized notifications or offers. Fancrick may automatically collect information about your computer hardware and software, including your IP address, device type, and access times. This information is used to operate the service, maintain its quality, and provide general statistics regarding the use of Fancrick.

To convert your winnings into cash and withdraw them into your bank account, you will need to provide bank account details and KYC (Know Your Customer) information, such as PAN (Permanent Account Number), as mandated by the Reserve Bank of India.

Third-Party Sharing

Fancrick does not sell, rent, or lease its customer lists to third parties. Fancrick may share data with trusted partners to perform statistical analysis, communicate with you, report on events, or provide customer support. These third parties are prohibited from using your personal information except to provide these services to Fancrick and must maintain the confidentiality of your information.

Legal Disclosures

Fancrick may disclose your personal information if required by law or in the good faith belief that such action is necessary to: (a) comply with legal processes; (b) protect and defend the rights or property of Fancrick; and/or (c) act under exigent circumstances to protect the personal safety of Fancrick users or the public.

Data Deletion

Users can request the deletion of their data by emailing [email protected]. Fancrick will delete the data within one month of the request or after seeking any necessary clarification for the deletion, whichever is later.

Modification of Terms

Except for Section 14, which provides for Dispute and Dispute Resolution, Fancrick reserves the right to modify or replace the Terms of Use at any time by posting the most current version on the Site. You are responsible for reviewing and becoming familiar with any such modifications. Fancrick may notify you of any change or revision to the Terms through your registered email. Your continued use of the Services after any modification to the Terms constitutes your acceptance of the Terms as modified.

Eligibility

By depositing money or entering a contest, you represent and warrant that:

You are 18 years of age or older.

You are a citizen or resident of India and have an address in India or are currently residing in India.

In certain Indian states (Assam, Odisha, Sikkim, Nagaland, Andhra Pradesh, Telangana, Tamil Nadu), participation in paid versions of the Contest may be barred by law.

At the time of deposit or game entry, you are physically located in India where participation in the contest is not prohibited by law.

You are not listed on any government list of prohibited or restricted parties, nor have you been convicted under gambling laws in India.

You will not misuse support services or submit false reports of abuse or misconduct.

You will abide by these Terms of Use and any other agreements with Fancrick regarding your use of the Service or participation in games.

If Fancrick determines that you do not meet these eligibility requirements, you are not authorized to use the Service. Fancrick may require proof of eligibility and may terminate your account, withhold or revoke prizes, or limit withdrawals if you are found ineligible.

Registration and Account Access

To participate in a Contest, you must register for an account, providing accurate and complete information. Fancrick may deny access or terminate accounts with inaccurate or incomplete information. You may establish only one account, and accounts cannot be co-owned. Fancrick reserves the right to suspend or terminate accounts and withhold or revoke prizes for multiple accounts or false information.

Your account should be used solely for participating in online gaming and fantasy sports Contests on the Service. Fancrick may suspend, limit, or terminate accounts used for depositing funds without the intention of participating in contests and may report such activity to relevant authorities.

Communications

By registering, you agree to receive communications from Fancrick. You may opt out at any time by unsubscribing or emailing [email protected]. Even after opting out, Fancrick may still communicate with you as permitted by law.

Disqualification and Cancellation

Fancrick reserves the right to cancel contests or disqualify users for improper conduct, including falsifying personal information, violating payment method terms, using unauthorized methods, tampering with the Service, or spamming other users. Forfeiture or return of prizes may be enforced, and Fancrick may pursue legal action for such conduct.

If the Service is disrupted due to technical issues or external factors, Fancrick reserves the right to disqualify implicated individuals and modify or suspend the Service.

Deposits and Withdrawals

By depositing funds or entering paid contests, you agree to provide necessary information for identity verification. Fancrick may conduct checks before processing withdrawals and may suspend accounts pending verification. Deposits and winnings are held in a segregated account, and Fancrick may limit deposit amounts as required by law.

Taxation

All prizes are subject to tax deduction as per the Income Tax Act 1961. You are responsible for filing and paying applicable taxes on any winnings, and Fancrick is not responsible for this.

Publicity

By entering a contest, you consent to Fancrick’s use of your name, voice, likeness, location, and photograph for promotional purposes, unless prohibited by law. Fancrick may make public statements about entrants and winners for marketing purposes. Participation and winning constitute complete compensation for your publicity obligations, and additional written waivers may be required for certain contests.

Game Rules

Game of Skill - Legality
In India, games of skill are legally distinct from gambling, as repeatedly affirmed by Indian courts, including the Supreme Court. The Nagaland Prohibition of Gambling and Promotion and Regulation of Online Games of Skill Act, 2015, clarifies that "games of skill" are those where skill outweighs chance. This includes games requiring strategic wagering, team selection, or virtual stock analysis.

Various high courts in India have confirmed the legality of fantasy sports, recognizing them as games of skill. Courts such as the Punjab and Haryana High Court, the Bombay High Court, and the Rajasthan High Court have upheld this position. Playing fantasy sports requires significant skill, as participants must create teams based on their deep understanding of the sport and its players.

Fancrick's contests are also considered games of skill. Success in these contests depends on participants' knowledge of cricket or other sports, including player statistics, performance under specific conditions, and dedication. Winners are those who use their expertise to accumulate the most fantasy points, based on athletes' real-world performance.

Contest(s) and Team(s)

Fancrick offers various contests on its platform, primarily for fantasy cricket. Users ("Gamers") can create fantasy teams ("Teams") comprising real-life cricketers participating in actual matches or tournaments ("Sport Events"). Gamers can modify their teams up to the official start time of the match. If the match time is unverifiable, Fancrick may adjust the deadline accordingly.

Fancrick reserves the right to extend deadlines or cancel contests due to delays caused by weather, technical issues, or other factors. All contests are governed by Fancrick's "Fantasy Rules." Both free and paid contests are available, with entry fees covering the Platform Service Fee ("PSF") and contributions to the prize pool.

Gamers can create multiple teams for contests related to a Sport Event but generally, only one entry per contest is allowed unless specified otherwise. In Multiple Entry Contests, users can submit multiple entries, subject to Fancrick's discretion on the maximum number allowed.

Gaming Currency and Virtual Wallet

Fancrick uses a virtual currency called 'Gold Nanyas,' which can be bought with real money, awarded as promotions, or earned from winning contests. Gold Nanyas are stored in a virtual wallet named Gullak and can be used to enter paid contests. Winning Nanyas can be converted to real money, gift cards, or discount coupons.

Entry Fees

Paid contests on Fancrick require an entry fee in Gold Nanyas, debited from the user's Gullak account. Participation is confirmed upon fee payment, and cancellations are not allowed. Once a match starts, entries and team changes are locked.

Gullak Sub-Accounts and Payment Terms

Fancrick maintains two primary account categories for payments: (i) Recharge Account and (ii) Winnings Account, along with a Promo Bonus Account for promotional Gold Nanyas. Gamers' winnings are credited to their Winnings Account, which can be converted to real money or redeemed for prizes. Payments for contest entry fees are first debited from the Entry Fee balance and then from the Withdrawable balance if needed.

Withdrawals from the Recharge Account require a minimum of Rs. 200 and must be used within 335 days, after which unused amounts may be forfeited. Winnings can be withdrawn online, subject to validation of the user's bank account and identification. Fancrick may forfeit amounts if users fail to provide necessary documentation.

The payment for participating in contests includes a platform fee for Fancrick services and the user's contribution to the prize pool. Fancrick holds collected amounts in a separate account, distributing them to winners, covering platform fees, and paying government taxes.

Contest Term

Fancrick hosts contests for professional cricket events, typically lasting one day (T20s and one-day matches) or up to five days (Test matches).

Fantasy Points Calculation

Fancrick may use third-party providers or the official match organizer's website to gather the scores and information needed to compute and tabulate fantasy points. In the rare event that there are errors in the computation or tabulation of fantasy points, selection of winners, or if a match is abandoned due to inaccuracies or incomplete data from these sources, Fancrick will make every effort to correct such errors before distributing prizes. However, Fancrick relies on the accuracy and completeness of the third-party data and does not guarantee its precision. Consequently, Fancrick is not responsible for inaccuracies in the computation of fantasy points or the selection of winners due to any erroneous or incomplete data from these sources. Gamers agree not to hold Fancrick accountable for such issues.

Determining Winners

Winners are determined based on the scores of the Teams in a specific match, which could last from one day to an entire tournament. The Gamer(s) with the highest aggregate score in a match will be declared the Winner(s). In some contests, Fancrick may designate multiple winners and distribute prizes according to the Teams' aggregate scores. The number of winners and their respective prizes will be specified on the Contest page before it begins. The points system used to determine Team scores can be found here.

Gamers who create Teams on behalf of other individuals will be disqualified.

In the event of a tie, the prize will be equally divided among the tied Gamers.

Fancrick will not pay any prizes if it finds that the Winner(s) have violated these Terms and Conditions, or other rules and regulations regarding the Fancrick App, Contest, "Fantasy Rules", etc.

Prizes

After each contest ends, tentative winners are announced, usually by the following day, pending final verification. Players in each contest who accumulate the most fantasy points and comply with eligibility requirements and applicable rules will win prizes, as detailed in the contest information. Prizes in the form of Gold Nanyas (Winning Nanyas) are added to the winning player's Gullak account balance. In the case of a tie, the prize is divided evenly among the tied players unless otherwise stated. Fancrick reserves the right to announce results or prizes even a day later if circumstances require.

Fancrick offers various types of contests, each with specified entry fees and prizes, announced in advance on the contest page. You can view the current contests, entry fees, and prizes by logging in and visiting the main lobby.

Prize calculations are based on the results at the time of final scoring by Fancrick. Once winners are announced, the scoring results will not change due to official adjustments by professional leagues. Fancrick reserves the right to make adjustments for errors or irregularities in data transmission or result calculations. Noncompliance with the Terms may also prompt adjustments. Fancrick may reverse payments if necessary and expects Gamers to cooperate in such instances.

If the awarding of any prizes is legally challenged, Fancrick reserves the right to decide whether to award or adjust such prizes at its sole discretion. In disputes regarding the determination of winners, Fancrick's decision is final and binding.

Verification and Taxation

Only Winners who complete the verification process and submit the required documents within the specified time will be allowed to withdraw their winnings. Fancrick will not entertain claims for extensions of the document submission deadline.

Fancrick will scrutinize all submitted documents and may disqualify any Winner from withdrawing their winnings if any submitted document or information is found to be incorrect, misleading, false, fabricated, incomplete, or illegible, or if the Gamer does not meet the Eligibility Criteria specified in Section 3.

All prizes are subject to TDS under the Income Tax Act 1961. The current TDS rate for any prize amount over Rs. 10,000 is 30%. TDS will be deducted from Net Winnings (prize amount - contest entry fee - promo bonus). If the TDS rate changes, Fancrick will deduct TDS according to the revised rate. Winners will receive TDS certificates for the tax deductions. Winners are responsible for paying any additional taxes, including income tax or gift tax, on the prize money.

Notification

Winners' names are typically posted on the App after each contest concludes, and by 10 AM IST the following day at the latest. Winners will also receive notifications on their App. Winners may be asked to submit an affidavit of eligibility, a publicity agreement, and appropriate tax forms by a specified deadline. Failure to comply can result in disqualification. Undeliverable prize notifications may also lead to disqualification and selection of an alternate winner. For a list of winners and their names, email [email protected]. Fancrick may, at its discretion, announce results or prizes even after a day if warranted by circumstances.

Promotions and Promo Bonus

To conduct promotional activities, Fancrick may issue promotional Gold Nanyas (Promo Bonus) for participation in any Contest(s). Users cannot transfer or request the transfer of any amount into the Promo Bonus.

The use of any Promo Bonus is subject to limitations and restrictions, such as the time within which it must be used, as notified to the user at the time of issuance. The issuance of any Promo Bonus is at Fancrick's sole discretion and cannot be demanded by any User. The Promo Bonus may be used to contribute to the prize pool in any Contest, in accordance with these Terms and Conditions. Promo Bonus cannot be withdrawn or transferred to any other account or person. If a user terminates their account, or Fancrick terminates the account, all Promo Bonus points will revert to Fancrick. Fancrick reserves the right to reclaim any unutilized Promo Bonus after a certain period.

Referrals and Referral Bonus

The Fancrick "Refer Friends and Family" Program allows you to invite friends and family to join Fancrick. If both you and your referred friend meet the criteria and complete the necessary steps, you will both earn a Referral Bonus from Fancrick. This Referral Bonus is part of the withdrawable balance of Gullak and can be used to pay entry fees for Contests on the Fancrick App, redeemed for gift cards/discount coupons, or exchanged for real money into a bank account. Participation in the Program is governed by the following terms and conditions ("Program Terms"):

Eligibility: To participate, users must:

Have a verified account registered with the Fancrick Platform.

Be eligible to participate in pay-to-play Fancrick fantasy cricket as per Fancrick's terms and conditions.

Have downloaded and installed the Fancrick App on their mobile devices.

Participation in the Program by proxy is not allowed, and it is voluntary. Users cannot register or operate more than one account and must use only one account for participation. To participate, download and install the Fancrick App. Through the App, you will get a unique link or code to share with friends ("Referee"). The Referee can either:

Click on the link to be directed to a registration page, register an account, and download the App.

Download and install the App independently, register for an account, and enter the unique code.

Upon successful registration and mobile number verification of the Referee, the Referrer will receive the Referral Bonus, and the Referee will receive the Promo Bonus. This is subject to:

The Referee not being an existing Fancrick user.

Both the Referrer and Referee being eligible for pay-to-play Fancrick fantasy cricket.

The Referee registering through the unique link or code shared by the Referrer.

Statistics Providers

Fancrick utilizes third-party service providers to obtain score feeds and other information required for computing and tabulating fantasy points. In the rare event of errors in computation, selection of winners, or match abandonment due to inaccurate or incomplete data from third-party providers, Fancrick will strive to rectify such errors before distributing prizes.

Conduct

As a condition of using the Services, you agree not to use them for any unlawful or prohibited purposes or any other purposes not reasonably intended by Fancrick. You specifically agree not to:

Abuse, harass, impersonate, intimidate, or threaten other users.

Post or transmit any content that is infringing, libelous, defamatory, abusive, offensive, obscene, pornographic, or otherwise violates any law or third-party rights.

Use the Service for any unauthorized purposes or in violation of applicable laws, including intellectual property laws.

Post or transmit any communication or solicitation designed to obtain a password, account, or private information from any user.

Create or submit unwanted email ("Spam") to any user.

Infringe upon the intellectual property rights of Fancrick, its users, or any third party.

Submit comments linking to affiliate programs, multi-level marketing schemes, or off-topic content.

Post, email, transmit, upload, or otherwise make available any material containing software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any software or hardware.

Use any robot, spider, scraper, sniping software, or other automated means to access the Service without express written permission.

Additionally, you agree not to:

Take any action imposing an unreasonable or disproportionately large load on our infrastructure.

Interfere with the proper working of the Service or any activities conducted on the Service.

Bypass any measures used to prevent or restrict access to the Service.

Use artificial means, such as creating multiple accounts, to inflate your position on leaderboards.

Use unauthorized scripts; all authorized scripts will be available through the Service.

Advertise to or solicit any user to buy or sell products or use information from the Service to contact users without their prior consent.

Sell or transfer your profile.

Attempt to influence play in any sporting event from which athletes are available for selection in Fancrick contests.

Violating these rules may result in the removal of your content, forfeiture of winnings, and/or cancellation of your account. Fancrick may remove any User Content and terminate accounts at any time for any reason. To report violations, please contact us.

User Content

You are responsible for all content you upload, post, share, email, transmit, or otherwise make available via the Service ("User Content"). Fancrick is not liable for any User Content.

Fancrick may pre-screen, refuse, delete, modify, or move any User Content at its discretion. Using the Service may expose you to content you find offensive or objectionable. You bear all risks associated with the use or disclosure of any User Content and acknowledge that Fancrick may remove content violating these Terms or deemed objectionable.

By submitting User Content, you grant Fancrick an irrevocable, sublicensable, perpetual, worldwide, royalty-free, non-exclusive license to use, distribute, reproduce, modify, adapt, publish, translate, perform, and display such content.

You are solely responsible for interactions with other users. Fancrick reserves the right to monitor disputes but is not obligated to do so.

Indemnity

You agree to release, indemnify, defend, and hold harmless Fancrick, along with its parents, subsidiaries, affiliates, and agencies, as well as the officers, directors, employees, shareholders, and representatives of these entities, from any and all losses, liabilities, expenses, damages, costs (including attorneys’ fees and court costs), claims, or actions arising from your use of the Service. This includes any violations of these Terms of Use, your receipt, ownership, use, or misuse of any prize, and any acts or omissions that implicate publicity rights, defamation, or invasion of privacy. You shall indemnify, defend, and hold Fancrick and its parents, subsidiaries, affiliates, agencies, officers, directors, employees, shareholders, and representatives harmless from any third-party claims related to your engagement with Fancrick or participation in any contest. Fancrick reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with Fancrick in the defense of such matters. Your indemnity includes any loss or damage, including attorneys' fees and litigation expenses. You agree to indemnify Fancrick against any third-party claims, including intellectual property rights infringement, arising from your display or use of logos, names, marks, trademarks, copyrights, or other rights on Fancrick.

Warranty Disclaimers

You understand and agree that your use of the Service is at your sole risk. The Service (including all Content) is provided on an "AS IS" and "as available" basis without any warranties, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. You acknowledge that Fancrick has no control over, and no duty to take any action regarding: which users access or use the Service; what effect the Content may have on you; how you may interpret or use the Content; or what actions you may take as a result of being exposed to the Content. You release Fancrick from all liability related to acquiring or not acquiring Content through the Service. The Service may contain, or direct you to, other websites with information that some may find offensive or inappropriate. Fancrick makes no representations about any Content contained in or accessed through the Service, and will not be responsible or liable for the accuracy, copyright compliance, legality, or decency of material contained in or accessed through the Service.

Limitation of Liability

Accessing the Fancrick App is voluntary and at your own risk. Fancrick is not responsible for any loss or damage (including but not limited to accidents, injuries, death, or loss of property) sustained by you or any other person during the use of Fancrick Services, including participation in Contests, or as a result of accepting any prize. Fancrick accepts no liability for any errors or omissions, whether on behalf of itself or third parties, related to prizes.

You are solely responsible for any consequences arising from illegal acts or non-conformity with these Terms and other rules, including providing incorrect addresses or personal details. In consideration of Fancrick allowing users to access the Services, users waive and release all rights or claims against Fancrick, its agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for any injuries, accidents, or mishaps arising out of the provision of Fancrick Services or related to Contests or prizes.

To the extent permitted by law, Fancrick is not responsible for any harm from downloading or accessing information or material, quality of servers, games, products, services, or sites, or cancellation of competitions and prizes. If you pay for access to Fancrick’s Services, you will not be entitled to a refund due to inaccessibility caused by server maintenance, service provider failures, computer viruses, natural disasters, or other causes beyond Fancrick’s control.

Our Proprietary Rights

All title, ownership, and intellectual property rights in and to the Service (including content created by Fancrick, its partners, affiliates, and/or users) are owned by Fancrick or its licensors. Material published on Fancrick, including but not limited to games, contests, software, advertisements, written content, photographs, graphics, images, illustrations, marks, logos, audio or video clippings, and flash animation, is owned by Fancrick or its licensors. Users may not modify, publish, transfer, reproduce, distribute, publicly display, or exploit any material published on Fancrick without express consent and license from Fancrick. You acknowledge that the Service contains proprietary and confidential information protected by intellectual property and other laws. Except as expressly authorized by Fancrick, you agree not to copy, modify, rent, lease, loan, sell, distribute, perform, display, or create derivative works based on the Service, in whole or in part.

Links

The Service may provide, or third parties may provide, links to other internet sites, applications, or resources. Fancrick has no control over such sites, applications, and resources, and is not responsible for their availability, content, advertising, products, or other materials. You acknowledge that Fancrick is not responsible or liable for any damage or loss caused by or in connection with the use or reliance on any content, goods, or services available through such sites or resources.

Termination and Suspension

Fancrick may terminate or suspend all or part of the Service and your Fancrick account immediately, without prior notice or liability, if you breach any terms or conditions of these Terms. Upon termination of your account, your right to use the Service will cease immediately. If you wish to terminate your Fancrick account, you may contact Fancrick via the contact form with a note indicating your desire to terminate your account. The following provisions of the Terms will survive any termination:

Conditions of Participation, except Registration and Account Access and Security;

Provisions of Bonuses and Promotions under Game Rules;

User Content provision under Conduct;

Indemnity;

Warranty Disclaimers;

Limitation on liability;

Fancrick’s Proprietary Rights;

General Information.

If your account is subject to suspension, you must adhere to the restrictions and limitations imposed on your account and communicate with Fancrick regarding account restoration only via [email protected].

No Third-Party Beneficiaries

You agree that, except as expressly provided in these Terms, there shall be no third-party beneficiaries to these Terms.

Dispute and Dispute Resolution

The courts of competent jurisdiction in Mumbai shall have exclusive jurisdiction over any and all disputes arising out of or in connection with the Fancrick Services provided by Fancrick (including Contests), the construction, validity, interpretation, and enforceability of these Terms, or the rights and obligations of Users (including Participants) or Fancrick. All such issues shall be governed by the laws of the Republic of India.

In the event of a legal dispute, the party raising the dispute shall provide a written notification ("Notification") to the other party. Upon receipt of the Notification, the parties shall first attempt to amicably resolve the dispute through discussions. If the dispute is not resolved within fifteen (15) days of receipt of the Notification, it shall be settled by arbitration. The seat of arbitration shall be Mumbai, India, and all arbitration proceedings shall be conducted in English in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time.

The arbitration shall be conducted by a sole arbitrator, mutually appointed by both Parties within thirty days of receipt of a notice from either party requesting such appointment.

The arbitration award will be final and binding on the Parties, with each Party bearing its own costs of arbitration and equally sharing the fees of the arbitrator, unless otherwise decided by the arbitral tribunal. The arbitrator may issue interim orders and awards, including orders for specific performance, which will be enforceable in competent courts. The arbitrator shall provide a reasoned award.

Nothing in these Terms shall prevent Fancrick from seeking and obtaining interim or permanent equitable or injunctive relief, or any other relief available to safeguard Fancrick's interests, from any court having jurisdiction. The pursuit of equitable or injunctive relief shall not constitute a waiver by Fancrick to pursue any remedy for monetary damages through arbitration.

Miscellaneous

Fancrick may be required under certain legislations to notify Users of certain events. Users acknowledge and consent that such notices will be effective upon Fancrick posting them on the Fancrick App or delivering them through the email address provided during registration. Users may update their email addresses by logging into their accounts on the Fancrick App. If they do not provide accurate information, Fancrick cannot be held liable for failure to notify the User.

Fancrick shall not be liable for any delay or failure to perform due to causes outside its reasonable control, including but not limited to acts of God, war, terrorism, riots, pandemics, embargoes, acts of civil or military authorities, fires, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, fuel, energy, labor, or materials, or any cancellation of any cricket/other match to which a Contest relates. In such circumstances, Fancrick is entitled to cancel any related Contest(s) and process appropriate refunds for all Participants.

Fancrick's failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Users agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of Fancrick or these Terms must be filed within thirty (30) days of such claim or cause of action arising or be forever barred.

These Terms, including all incorporated terms, conditions, and policies, constitute the entire agreement between the User(s) and Fancrick Interactive Private Limited and govern your use of the Fancrick App, superseding any prior agreements.

If any part of these Terms is determined to be indefinite, invalid, or otherwise unenforceable, the remaining parts shall continue in full force.

Fancrick reserves the right to moderate, restrict, or ban the use of Fancrick, specifically to any User or generally, in accordance with Fancrick’s policies from time to time, at its sole discretion and without notice.

Fancrick may, at its sole discretion, permanently close or temporarily suspend any Fancrick Services (including any Contest(s)).

Fancrick may from time to time conduct or organize promotions or offers on the platform. Any two or more promotions cannot be combined with any other promotions running simultaneously on the Fancrick platform. Promotions or offers cannot be combined with Cash Bonus available to any user.
